By downloading, installing, or using the Happy Valley Friends mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. If you are a parent or guardian, you are responsible for your child's use of the App.
Happy Valley Friends is an educational entertainment app designed for children ages 2-5. The App includes interactive mini-games, musical activities, and learning experiences featuring original animal characters. The App is available for iOS devices through the Apple App Store.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple device that you own or control, subject to these Terms and the Apple App Store Terms of Service. This license does not allow you to:
- Copy, modify, or distribute the App or its content
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any copyright or trademark notices
- Use the App for any commercial purpose without our written consent
All content in the App, including but not limited to characters, artwork, animations, music, sound effects, game designs, and text, is the exclusive property of Happy Valley Friends and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content in the App without our express written permission.
The App may offer in-app purchases managed through the Apple App Store. All purchases are subject to Apple's payment terms and refund policies. Parental controls and purchase restrictions are protected behind an age-verification gate to prevent unauthorized purchases by children. You are responsible for managing purchase settings on your device.
Happy Valley Friends is committed to providing a safe environment for children. The App:
- Contains no third-party advertisements
- Does not link to social media or external websites
- Operates fully offline after download
- Does not collect personal information from children
- Protects parental features behind an age-verification gate
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, availability, or fitness for a particular purpose. While we strive to keep the App free of errors and bugs, we do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, Happy Valley Friends shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability for any claims arising from your use of the App shall not exceed the amount you paid, if any, for the App.
We may update the App from time to time to add new features, fix bugs, or improve performance. We may also update these Terms at any time. Continued use of the App after changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App. You may stop using the App at any time by deleting it from your device.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in Brooklyn, New York.
